PAYMENT PROCESSING FEES DISCLOSURE:

You may set up recurring donations with specified frequency and amounts. You can modify or cancel recurring donations at any time through your account settings. We will notify you before processing each recurring donation and if any payment issues occur.
Platform Verification Disclosure:
When you make a donation through our platform, the transaction is final and not disputable unless unauthorized use of your payment method is proved. CLASS ACTION WAIVER: YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST DONATOR.ORG ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
Exceptions: This arbitration agreement does not prevent you from: (1) Filing individual claims in small claims court; (2) Bringing claims to the attention of federal, state, or local agencies; (3) Seeking public injunctive relief in California under the McGill rule.

After account termination, we retain certain information as required by law, including donation records for tax reporting (7 years), fraud prevention data (5 years), and communication records (3 years). Personal data not required for legal compliance is deleted within 90 days.
We reserve the right to discontinue or modify our services with 30 days' notice. In case of service discontinuation, we will assist users in downloading their data and completing pending transactions. No refunds will be provided for discontinued services beyond pending transactions.
AI-generated content created through our platform cannot be copyrighted under current U.S. law. Such content enters the public domain upon creation. Users may modify and use AI-generated content freely, but cannot claim exclusive rights to unmodified AI output.
We comply with the Digital Millennium Copyright Act (DMCA). Copyright holders may submit takedown notices for infringing content. Users may submit counter-notices if they believe content was wrongfully removed. Repeated infringement may result in account termination.

These Terms are governed by the laws of the State of Washington and the United States, without regard to conflict of law principles. Any legal proceedings must be brought in the state or federal courts located in Washington State.

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with mergers, acquisitions, or other business transfers.
Neither party shall be liable for any failure or delay in performance under these Terms which is due to acts of God, natural disasters, epidemic, pandemic, war, terrorism, riots, civil unrest, actions of government authorities, strikes, labor disputes, shortages of materials or supplies, transportation delays, cyber attacks, or any other unforeseeable cause beyond the reasonable control of such party, provided that such party promptly notifies the other party and uses best efforts to remedy the situation.
The following provisions shall survive any termination or expiration of these Terms: Fee obligations, No Refund Policy, Intellectual Property Rights, Disclaimers and Limitation of Liability, Indemnification, Arbitration Agreement and Class Action Waiver, and any other provisions that by their nature should survive termination.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. All waivers must be in writing and signed by authorized representatives.
