These Terms of Service ("Terms") govern your use of Donator.Org, a charitable giving platform that combines donations to verified 501(c)(3) organizations with personalized handwritten greeting cards. By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy.

Donator.Org is operated by Donator.Org Inc., a for-profit corporation that facilitates charitable giving and provides premium greeting card services. We are committed to transparency in our operations while maintaining the highest standards of service and security.

Important Notice:

By using Donator.Org, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Acceptance of Terms

1.1 Agreement to Terms

By creating an account, making a donation, or using any part of our services, you enter into a legally binding agreement with Donator.Org Inc. These Terms apply to all users, including visitors, registered users, donors, and anyone who accesses our platform.

1.2 Age Requirements

  • • You must be at least 13 years old to use our services
  • • Users aged 13-17 must have parental consent to make donations
  • • You must be 18 or older to make financial transactions without parental consent
  • • We reserve the right to verify age and parental consent at any time

1.3 Capacity to Contract

You represent that you have the legal capacity to enter into this agreement and that you are not prohibited from using our services under the laws of the United States or any other applicable jurisdiction.

1.4 Updates to Terms

We may modify these Terms at any time. Material changes will be communicated via email or prominent website notice. Continued use of our services after changes constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.

2. Description of Our Services

2.1 Charitable Donation Platform

  • • Facilitating donations to verified 501(c)(3) charitable organizations
  • • Processing secure payments through trusted payment processors
  • • Providing tax-deductible donation receipts within 30 days
  • • Maintaining comprehensive charity verification and database services

2.2 Handwritten Greeting Card Services

  • • Premium greeting cards with authentic robotic handwriting using real ballpoint pens
  • • Personalized message creation with AI assistance
  • • Professional card design and premium cardstock materials
  • • Complete fulfillment including addressing, postage, and delivery

2.3 Platform Features

  • • User account management and recipient address books
  • • AI-powered message generation and personalization tools
  • • Donation history tracking and reporting
  • • Customer support and service assistance

2.4 Service Availability

Our services are available 24/7 through our website, subject to scheduled maintenance and updates. We strive for maximum uptime but cannot guarantee uninterrupted service. Card fulfillment and delivery are subject to processing times and postal service schedules.

2.5 Geographic Limitations

Donations can be made by users worldwide to U.S.-based 501(c)(3) organizations. Greeting card delivery is currently available within the United States only. We reserve the right to expand or limit geographic availability at our discretion.

3. User Accounts and Responsibilities

3.1 Account Creation

  • • Provide accurate, current, and complete information during registration
  • • Maintain and update your account information as needed
  • • Choose a secure password and enable two-factor authentication when available
  • • One account per person; multiple accounts are not permitted

By creating an account and agreeing to these Terms, you are automatically enrolled in our newsletter to receive updates about featured charities, new card collections, and exclusive offers. You can unsubscribe at any time through:

3.2 Account Security

  • • You are responsible for maintaining the confidentiality of your login credentials
  • • Notify us immediately of any suspected unauthorized access
  • • You are liable for all activities that occur under your account
  • • We are not responsible for losses due to unauthorized account access

3.3 Account Verification

We may require additional verification for account security, fraud prevention, or legal compliance. This may include identity verification, payment method confirmation, or other security measures. Failure to complete verification may result in service limitations or account suspension.

3.4 Account Suspension and Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose security risks. You may close your account at any time through your account settings or by contacting customer support.

4. Donations and Payment Processing

4.1 Donation Processing

  • • All donations are processed in U.S. dollars and transmitted to verified 501(c)(3) organizations
  • • Donations are typically processed within 1-3 business days
  • • Tax-deductible receipts are provided via email within 30 days
  • • Minimum donation amount is $1.00; maximum is $10,000 per transaction

4.2 Fee Structure and Payment Processing

PAYMENT PROCESSING FEES DISCLOSURE:

  • • Platform Service Fee: 6.5% of each donation amount
  • • Payment Processing Fee: 3.5% of each donation amount
  • • Total Combined Fee: 10.0% per donation
  • • You authorize us to deduct these fees as disclosed at the time of donation
  • • All fee calculations are displayed before payment confirmation
  • • Processing fees are non-refundable under all circumstances
  • • These fees are automatically deducted from each donation before funds reach the charity.

4.3 Payment Methods

  • • Major credit cards (Visa, Mastercard, American Express, Discover)
  • • PayPal and other electronic payment methods
  • • Bank transfers for large donations (contact customer support)
  • • All payments are processed securely with PCI DSS Level 1 compliance

4.4 Payment Security

We use industry-leading security measures including SSL encryption, tokenization, and fraud detection. Payment information is processed by certified third-party payment processors and is not stored on our servers. We comply with all applicable PCI DSS requirements.

4.5 Recurring Donations

You may set up recurring donations with specified frequency and amounts. You can modify or cancel recurring donations at any time through your account settings. We will notify you before processing each recurring donation and if any payment issues occur.

4.6 Charity Verification and Good Standing

Platform Verification Disclosure:

  • • We verify 501(c)(3) status with the IRS at time of onboarding for US-based charities
  • • International charities undergo different verification processes appropriate to their jurisdiction
  • • We confirm good standing with state regulatory authorities where required
  • • Verification is performed periodically but not continuously
  • • We do not guarantee ongoing compliance, financial management, or appropriate use of donated funds by charities
  • • Donors are encouraged to conduct independent research before donating
  • • We are not responsible for charity actions, omissions, or misuse of funds

4.7 Transaction Finality and Non-Disputable Donations

When you make a donation through our platform, the transaction is final and not disputable unless unauthorized use of your payment method is proved. By completing a donation, you acknowledge that you are making a voluntary charitable contribution without expectation of goods, services, or other benefits in return.

4.8 Sales Tax

Sales Tax Disclosure:

  • • Sales tax is charged ONLY on greeting card purchases (physical and digital cards)
  • • NO sales tax is charged on charitable donations
  • • NO sales tax is charged on gift card purchases
  • • Sales tax rates are calculated based on your billing address
  • • All applicable taxes are calculated and displayed before payment confirmation

4.9 Failed Payments

If a payment fails, we will attempt to process it again and notify you of the failure. For recurring donations, we may retry failed payments for up to 7 days. Continued payment failures may result in cancellation of recurring donations.

5. Greeting Card Services

5.1 Card Production and Quality

  • • Cards are produced using premium heavy cardstock with high-resolution imagery
  • • Handwriting is performed by advanced robotic technology using real Pilot G2 ballpoint pens
  • • Each card is individually crafted to ensure authentic pen-on-paper appearance
  • • Quality control measures ensure consistent, professional results

5.2 Personalization and Customization

  • • Custom messages up to character limits specified for each card design
  • • Font selection from our curated collection of handwriting styles
  • • AI-assisted message generation based on occasion and recipient
  • • Preview functionality to review your card before finalizing

5.3 Processing and Delivery Times

Delivery Timeline:

  • • Cards are handwritten and prepared within 3-5 business days
  • • Mailing typically occurs within 24 hours of completion
  • • Standard USPS delivery times apply (2-5 business days within U.S.)
  • • Delivery notification is available as an optional paid service

5.4 Delivery and Addressing

  • • All postage and shipping costs are included in the card price
  • • Accurate recipient addresses are required for successful delivery
  • • We are not responsible for delivery failures due to incorrect addresses
  • • Address verification services help ensure deliverability

5.5 Card Limitations

  • • Message content must comply with our community guidelines
  • • We reserve the right to refuse messages that are offensive, illegal, or inappropriate
  • • Character and line limits vary by card design and orientation
  • • Once cards enter production, modifications are not possible
6. User Content and AI Services

6.1 User-Generated Content

  • • You retain ownership of original content you create using our platform
  • • You grant us a license to use your content for providing our services
  • • You are responsible for ensuring your content does not infringe third-party rights
  • • We may remove content that violates our community guidelines or applicable law

6.2 AI-Generated Content Disclaimers

AI CONTENT NOTICE AND DISCLAIMERS:

  • • AI-generated content cannot be copyrighted under current U.S. law and enters the public domain
  • • AI suggestions are provided "AS IS" for convenience and inspiration only
  • • AI-generated content may contain errors, inaccuracies, biases, or inappropriate material
  • • You are solely responsible for reviewing, modifying, and approving all AI-generated content
  • • We do not guarantee the accuracy, appropriateness, quality, or legality of AI-generated content
  • • AI content is not a substitute for professional advice or human judgment
  • • You may not claim exclusive copyright to unmodified AI-generated content

6.3 Content Guidelines

  • • We encourage family-friendly content appropriate for greeting cards
  • • Please avoid offensive, discriminatory, or hateful language
  • • We recommend limiting personal information to recipient name and address
  • • Please be mindful of privacy and confidentiality when creating messages

6.4 Content Monitoring

We reserve the right to review, monitor, and remove content at our discretion. While we employ automated and manual content moderation, we do not pre-approve all content and are not responsible for user-generated content that violates these Terms.

6.5 Intellectual Property Respect

Do not use copyrighted material, trademarks, or other intellectual property without permission. Report suspected intellectual property violations to our support team. We respond to valid DMCA notices and other intellectual property claims.

7. Prohibited Uses and Conduct

7.1 Platform Misuse

  • • Using our services for any illegal or unauthorized purpose
  • • Attempting to circumvent security measures or access restrictions
  • • Interfering with or disrupting our services or servers
  • • Creating multiple accounts or sharing account credentials
  • • Using automated tools to access our services without permission

7.2 Fraudulent Activity

  • • Making false or fraudulent donations
  • • Using stolen or unauthorized payment methods
  • • Providing false personal or financial information
  • • Attempting to defraud charities, users, or Donator.Org
  • • Engaging in money laundering or other financial crimes

7.3 Content Violations

  • • Submitting offensive, inappropriate, or harmful content
  • • Using our platform for harassment, threats, or intimidation
  • • Violating privacy or sharing personal information without consent
  • • Infringing intellectual property rights
  • • Distributing malware, viruses, or harmful code

7.4 Commercial Restrictions

  • • Using our platform for commercial purposes without authorization
  • • Reselling or redistributing our services
  • • Competing with our business using our platform
  • • Collecting user information for commercial purposes

7.5 Enforcement Actions

Violations may result in warning, account suspension, termination, or legal action. We reserve the right to report illegal activities to law enforcement. Repeated violations will result in permanent account termination and may affect your ability to use our services in the future.

8. Disclaimers and Limitation of Liability

8.1 Service Disclaimers

Important Disclaimers:

  • • Our services are provided "as is" without warranties of any kind
  • • We do not guarantee continuous, uninterrupted, or error-free service
  • • We are not responsible for third-party charity actions or fund usage
  • • AI-generated content accuracy and appropriateness are not guaranteed

8.2 Charity Verification Limitations

  • • We verify 501(c)(3) status but do not guarantee charity performance or integrity
  • • Charities are independent organizations responsible for their own actions
  • • We are not liable for charity misuse of funds or operational failures
  • • Donors are encouraged to research charities independently

8.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DONATOR.ORG'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES (INCLUDING CONTRACT, NEGLIGENCE, STATUTORY LIABILITY OR OTHERWISE) OR CAUSES OF ACTION EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO DONATOR.ORG IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

THIS LIMITATION APPLIES TO ALL CLAIMS WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT DONATOR.ORG HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

8.4 Exclusion of Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.5 Force Majeure

We are not liable for delays or failures in performance resulting from acts beyond our reasonable control, including natural disasters, war, terrorism, strikes, government actions, or internet service failures.

8.6 Indemnification

You agree to indemnify and hold harmless Donator.Org, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or violation of any rights of third parties.

8.7 Comprehensive Indemnification

You agree to defend, indemnify, and hold harmless Donator.Org, its affiliates, and their respective officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, fines, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • • Your use or misuse of our Services
  • • Your violation of these Terms or applicable laws
  • • Your User Content, including AI-generated content
  • • Any donations you make or receive through the platform
  • • Disputes regarding platform fees or payment processing
  • • Claims by third parties related to your activities
  • • Chargebacks, disputes, or fraudulent transactions
  • • Your violation of any third-party rights
  • • Tax liabilities or reporting obligations

This indemnification obligation will survive termination of these Terms and your use of the Services.

9. Disputes, Refunds, and Resolution

9.1 Strict No Refund Policy

DONATION FINALITY AND NO REFUND POLICY:

ALL DONATIONS ARE FINAL AND NON-REFUNDABLE. Once a donation is processed, it becomes the property of the designated charity and cannot be returned, refunded, or redirected. This policy applies regardless of:

  • • Changes in your financial circumstances
  • • Disagreement with how the charity uses funds
  • • Errors in donation amount (unless proven unauthorized use)
  • • Charity losing tax-exempt status after donation
  • • Greeting card delivery issues or quality concerns
  • • Platform technical errors (we may offer credits at our discretion)

By donating, you acknowledge this is a voluntary charitable contribution without expectation of refund.

9.2 Donation Finality

  • • All donations are immediately processed and transmitted to charitable organizations
  • • Donations cannot be reversed, cancelled, or refunded once submitted
  • • Users are responsible for verifying donation amounts and recipient charities before submission
  • • Donor remorse, changed circumstances, or dissatisfaction are not grounds for refunds

9.3 Greeting Card Policy

  • • No refunds for greeting card purchases under any circumstances
  • • No refunds for cards with incorrect recipient addresses provided by users
  • • No refunds for cards refused by recipients or returned to sender
  • • No refunds for production delays, delivery issues, or quality concerns
  • • No refunds for user errors in message content, font selection, or card choices

9.4 Dispute Resolution Process

  • • Contact customer support within 30 days of the issue
  • • Provide detailed information and supporting documentation
  • • We will investigate and respond within 10 business days
  • • Escalation to management available for unresolved disputes

9.5 Chargebacks and Fraudulent Disputes

CHARGEBACK WARNING:

  • • Filing a chargeback for a legitimate donation constitutes fraud
  • • We vigorously defend against all non-fraud chargebacks
  • • Disputed donations forfeit any tax deduction benefits
  • • We will pursue all legal remedies for fraudulent chargebacks including:
  • - Collection of original amount plus fees and costs
  • - Reporting to credit agencies
  • - Criminal fraud prosecution where applicable
  • • Chargeback fee of $25 plus actual costs will be assessed

9.6 Binding Arbitration Agreement and Class Action Waiver

PLEASE READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS:

You and Donator.Org agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be settled by binding individual arbitration, except that each party retains the right to seek relief in small claims court and the right to seek injunctive or other equitable relief in a court of competent jurisdiction.

CLASS ACTION WAIVER: YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST DONATOR.ORG ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

Exceptions: This arbitration agreement does not prevent you from: (1) Filing individual claims in small claims court; (2) Bringing claims to the attention of federal, state, or local agencies; (3) Seeking public injunctive relief in California under the McGill rule.

The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator's award shall be final and binding, and may be entered as a judgment in any court of competent jurisdiction.

10. Account Termination and Service Suspension

10.1 Termination by User

  • • You may close your account at any time through account settings
  • • Contact customer support for assistance with account closure
  • • Closing your account does not cancel pending transactions or deliveries
  • • Some information may be retained for legal and regulatory compliance

10.2 Termination by Donator.Org

  • • We may suspend or terminate accounts for Terms violations
  • • Immediate termination for fraud, illegal activity, or security threats
  • • Warning notifications provided when possible before termination
  • • Appeals process available for wrongful termination claims

10.3 Effects of Termination

  • • Loss of access to account data, history, and platform features
  • • Pending transactions will be completed or refunded as appropriate
  • • Terminated users may not create new accounts without permission
  • • Legal obligations and liability limitations survive termination

10.4 Data Retention After Termination

After account termination, we retain certain information as required by law, including donation records for tax reporting (7 years), fraud prevention data (5 years), and communication records (3 years). Personal data not required for legal compliance is deleted within 90 days.

10.5 Service Discontinuation

We reserve the right to discontinue or modify our services with 30 days' notice. In case of service discontinuation, we will assist users in downloading their data and completing pending transactions. No refunds will be provided for discontinued services beyond pending transactions.

10.6 Platform Rights and Remedies

  • • We reserve the right to modify or discontinue Services with 30 days notice
  • • We may suspend or terminate accounts for Terms violations immediately
  • • We may report illegal activities to law enforcement authorities
  • • We may share information as required by legal process
  • • We retain the right to refuse service to anyone for any lawful reason
  • • We may implement additional security measures at our discretion
11. Intellectual Property Rights

11.1 Donator.Org Intellectual Property

  • • All platform content, design, code, and trademarks are owned by Donator.Org
  • • Users receive a limited license to use our services for personal, non-commercial purposes
  • • No right to copy, modify, distribute, or create derivative works
  • • Unauthorized use may result in termination and legal action

11.2 User Content Rights

  • • You retain ownership of original content you create
  • • You grant us a license to use your content for service provision
  • • License includes right to reproduce, display, and transmit your content
  • • License terminates when you delete content or close your account

11.3 Third-Party Content

  • • Respect copyright, trademark, and other intellectual property rights
  • • Obtain permission before using protected content
  • • Report suspected intellectual property violations
  • • We respond to valid DMCA notices and takedown requests

11.4 AI-Generated Content

AI-generated content created through our platform cannot be copyrighted under current U.S. law. Such content enters the public domain upon creation. Users may modify and use AI-generated content freely, but cannot claim exclusive rights to unmodified AI output.

11.5 DMCA Compliance

We comply with the Digital Millennium Copyright Act (DMCA). Copyright holders may submit takedown notices for infringing content. Users may submit counter-notices if they believe content was wrongfully removed. Repeated infringement may result in account termination.

11.6 Trademark Policy

Use of third-party trademarks without permission is prohibited. This includes charity logos, brand names, and other protected marks. Fair use exceptions may apply for commentary or identification purposes. Report trademark violations to our support team.

12. General Legal Provisions

12.1 Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Washington and the United States, without regard to conflict of law principles. Any legal proceedings must be brought in the state or federal courts located in Washington State.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Invalid provisions will be replaced with valid provisions that most closely achieve the intended effect.

12.3 Entire Agreement

These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and Donator.Org. They supersede all prior agreements, communications, and understandings.

12.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with mergers, acquisitions, or other business transfers.

12.5 Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms which is due to acts of God, natural disasters, epidemic, pandemic, war, terrorism, riots, civil unrest, actions of government authorities, strikes, labor disputes, shortages of materials or supplies, transportation delays, cyber attacks, or any other unforeseeable cause beyond the reasonable control of such party, provided that such party promptly notifies the other party and uses best efforts to remedy the situation.

12.6 Survival of Terms

The following provisions shall survive any termination or expiration of these Terms: Fee obligations, No Refund Policy, Intellectual Property Rights, Disclaimers and Limitation of Liability, Indemnification, Arbitration Agreement and Class Action Waiver, and any other provisions that by their nature should survive termination.

12.7 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. All waivers must be in writing and signed by authorized representatives.
